1. PURPOSE OF THE RAFFLE

Funds raised through this raffle will be used by Potch GIM NPC in accordance with its approved objectives under National Lotteries Commission Scheme 00550/01.

Proceeds will support Potchefstroom Gimnasium and related educational development initiatives, including but not limited to maintenance and upgrading of school infrastructure and equipment

All funds will be administered and reported in line with NLC requirements.

2. ELIGIBILITY

2.1 Entry is open to all persons aged 18 years or older who are legally capable of entering into a binding agreement.

2.2 Employees, directors, trustees, committee members, contractors, consultants, and any other persons directly involved in the administration, management, promotion, ticketing system, or draw process of the raffle conducted by the promoter, as well as their immediate family members (including spouse or life partner, parents, children, and siblings, whether biological, adopted, step, or in-law), and any person residing in the same household as such individuals, are not eligible to participate in the raffle or receive any prize.

2.3 Minors: If a ticket is purchased by a person under the age of 18, such purchase will be deemed to have been made by their parent or legal guardian, who will be regarded as the official participant and ticket holder.

3. TICKET SALES

3.1 Tickets are sold at R150 per ticket.

3.2 A maximum of 5,000 tickets will be issued for the raffle.

3.3 Tickets are sold online via approved payment platforms only.

3.4 Each ticket will be assigned a unique ticket number generated by the official system.

3.5 A ticket is only valid once full payment has been received and successfully confirmed by the payment system.

3.6 Tickets are non-transferable and non-refundable unless required by law.

3.7 The organiser shall not be liable for failed transactions where payment is not successfully confirmed by the official payment system.

4. TICKET RECORDS AND VERIFICATION

4.1 The promoter will maintain a secure and auditable register of all tickets issued.

4.2 Records will include:

• Ticket number
• Purchaser name
• Contact details
• Payment confirmation
• Date of purchase

4.3 No manual ticket numbers may be issued outside the official system.

5. CLOSING DATE, DRAW DATE & EXTENSIONS

5.1 Ticket sales will close on the official closing date published on:

• potchgim.co.za (or official website as designated)
• Official social media pages of Potch GIM NPC
• Approved marketing platforms

5.2 The draw date will be the official date published on the same platforms listed above, and will also appear on all official ticket materials in compliance with the Lotteries Act.

5.3 The promoter may extend or amend the ticket sales closing date or draw date if required, including where minimum ticket sales have not been reached.

5.4 Any changes will be communicated at least through:

• Official website
• Official social media pages
• Official WhatsApp communication channel
• Approved marketing platforms

5.5 No amendment will take effect before it has been publicly published on the above platforms.

6. THE PRIZE

6.1 The prize is one motor vehicle as advertised in official promotional material.

6.3 The vehicle will be delivered in roadworthy condition and transferred to the winner in accordance with South African legal requirements.

6.4 The prize is not exchangeable for cash.

6.5 The promoter may substitute the prize with a vehicle of equal or greater value and substantially similar specification if required due to availability or circumstances beyond its control.

 

7. THE DRAW

7.1 The draw will take place on the advertised date at a public event.

7.2 The winner will be selected using a verifiable, random and auditable selection process.

7.3 The draw process will include a:

• Independent attorney
• Independent auditor
• Full video recording
• Signed draw report

7.4 The first valid ticket drawn will be declared the winner.

8. WINNER NOTIFICATION

8.1 The winner will be contacted using the details provided at the time of ticket purchase via phone, WhatsApp, and email.

8.2 The winner must claim the prize within 30 days of notification.

8.3 If the winner cannot be contacted or fails to claim the prize within 30 days, a redraw may be conducted under the same controlled process.

8.4 It is the responsibility of the participant to ensure that contact details provided are accurate and up to date.

9. PRIZE COLLECTION

9.1 The winner must present valid identification before receiving the prize.

9.2 Ownership transfer of the vehicle will be arranged by the promoter in accordance with legal requirements.

9.3 Any additional costs related to licensing, insurance, or registration shall be for the winner’s account unless otherwise stated.

9.4 Any collection, delivery, or transport costs associated with the prize, including travel or logistics if the winner resides outside Potchefstroom, shall be for the account of the winner unless otherwise stated.

10. REFUNDS

All tickets are non-refundable except where required by law.

11. FRAUD AND FAIRNESS

11.1 Any attempt to interfere with the raffle process, ticket system, or draw will result in disqualification.

11.2 The promoter reserves the right to invalidate any ticket suspected of fraud, duplication, or system manipulation.

11.3 The official ticket register is the only valid record of entries.

11.4 OFFICIAL RECORDS AND DISCREPANCY

In the event of any discrepancy between promotional material, marketing communication, or third-party publications and these Terms and Conditions, the provisions of these Terms and Conditions and the official promoter records shall prevail. No representation made outside of these Terms and Conditions shall be binding unless confirmed in writing by the promoter and published on the official communication channels.

12. DATA PROTECTION (POPIA)

12.1 Personal information collected will include name, contact details, and payment confirmation details.

12.2 Information will be used solely for:

• Administering the raffle
• Processing ticket sales
• Contacting participants
• Announcing and verifying the winner

12.3 Data will be stored securely and will not be sold or shared with third parties except where required by law.

12.4 Participants consent to the use of their information for raffle administration purposes and public winner announcement for transparency.

12.5 Participants acknowledge and consent that their name may be publicly announced if they are selected as the winner.

13. LIABILITY

The promoter is not liable for:

• Technical failures affecting ticket purchases
• Loss or delay caused by systems outside its control
• Indirect or consequential damages
• “force majeure events”, including system outages or third-party service failures

Participation is at the participant’s own risk.

14. AMENDMENTS

14.1 The promoter may amend these Terms and Conditions where necessary, provided that:

• Amendments do not materially disadvantage participants who have already purchased tickets
• All amendments are publicly published before taking effect

14.2 Amendments will be published on:

• Official website
• Official social media pages
• Official WhatsApp communication channel
• Approved marketing platforms

15. DISPUTE RESOLUTION

15.1 Any dispute must be submitted in writing within 14 days of the draw to the official promoter contact.

15.2 The promoter will review and respond within a reasonable period.

15.3 The promoter’s decision will be final, subject to the jurisdiction of South African courts.

16. CANCELLATION

If the raffle cannot proceed for any reason beyond the promoter’s control, the promoter will act in accordance with applicable laws and NLC requirements.

17. PUBLICATION AND TRANSPARENCY

The winner will be announced on official platforms including social media and websites to ensure transparency.

18. ACCEPTANCE

By purchasing a ticket, participants confirm that they have read, understood, and agree to these Terms and Conditions.

19. LEGAL COMPLIANCE

This raffle is conducted in accordance with South African law and under approval from the National Lotteries Commission under Scheme 00550/01.
